got it on contract from carphone wharehouse 3 weeks ago, do you reckon i should take it back and what are my rights ?

phone battery takes average 1 hour or maybe more to fully charge from nil/ empty.

after use of 10-20 mins phone is roasting hot.

battery dies easilly, i can really see big difference between batt life on iphone and samsung s4

what are my rights if i am not happy ? change to other phone ? or cancel contract which i mite well do if i can, im on o2 2 yr contract free s4 phone , unlimited calls texts and 2gb internet a month for £28.00

The phone has never been 'fit for purpose' and therefore you have never legally 'accepted' it. That means that you have the right to a full refund (rather than just to a repair or replacement, as you would if a fault had occurred some time after 'acceptance' from you).

Since the phone contract was contingent upon you having a fully-working phone to go with it, you are entitled to void that contract without penalty.

If you put 'samsung battery overheating' into Google, you'll find loads of links and they all seem to mention the Galaxy S4.

thanks benito great link, does this mean , maybe i can take it back and get a replacement of another brand phone . or siply terminate my contract with carphone wharehouse ?

You have the legal right to terminate your contract (as per my second paragraph above) but, in practice, you'll probably find it a great deal easier simply to seek a replacement phone.
I have had an S4 for over a year and it does get quite hot when the processor is stressed, but it's not a problem unless the phone starts randomly rebooting. Being hot is normal and is not the same as overheating.

As for battery life, how long does it last? 1 hour? 6 hours? With very heavy use (games, videos, etc) I would expect a fully charged battery to last maybe 4 or 6 hours. Normal phone use with a bit of internet or games here and there and it should last all day. There was a batch of dodgy batteries which would die within half an hour or so. If this is happening then insist on a replacement battery, otherwise any other phone will behave in much the same way so no point changing it.
