USA visa waiver program

A client of mine, wwith a criminal record as long as your arm, including prison, successfully holidayed twice in the USA without a visa. He simply lied in the application and said he had no convictions. He told me that due to confidentialty laws and the data protection act, the US has no right to access UK police records for the purposes of issuing visas. Is he correct or just lucky to have been overlooked?

Would suspect the latter. No expert on this but would imagine matters of national security override the DPA.

definiately the latter one of my friends was sent back on the next plane when they found he was arrested for 16thof an ounce of hash

but how did they find out about the hash if he didn't tell them?
