my friend has recentley been driving to work without insurance, yesterday accidently i came off my push bike and went straight into his car!! causing minimal amount of damage(small scratch!!!!!) he now reckons i have to pay. but he shouldnt of even been on the road! what does anyone else think?

Your friend shouldnt have been driving without insurance, but regardless of that, I would have thought that morally (or out of courtesy), if you damage someone else's property, you should pay to have it repaired

I would inform that you have reported the accident to the Police and that they are looking into the accident. I would also ask for the name of his insurance company, so that you can inform them of his claim against you.


Lastly, report him to the Police. I have no sympathy for anyone who drives without insurance.

me, ide pay part of the cost on condition that the repair was done. accidents happen, thats why the law states we need insurance.

dont pay! wat would og f happened if u wer in a car and hit him u couldnt claim insurance coz he aint got any for urs to contact!!!Buy him to get some t cut and tell him wat he can do with it
Tell him you can't afford to pay, and he should claim it on his insurance (if he'd had fully comp with no excess, it would have covered it). That'll put the wind up him.

In terms of your rights, a lot will depend on where the accident took place and whether or not he was stationery at the time. But the thing is, you have him over a barrel. He makes you pay, you grass on him. Use it as a bargaining tool - get some photos of him on the road, if you can.

Your friend may not have a car to drive to work to in the future. There's a wizard little piece of legislation that allows the police to take uninsured vehicles from owners and if they don't produce valid insurance - they crush it! He won't be able to notice the scratch then. Just let your local police know and smile while they take his car away.



I agree that you shouldn't pay him, but on a separate note, it may be worth you taking out insurance for your pushbike, as if you had hit an insured car, and damaged it, the driver/owner would be entitled to pursue you for damages. Without insurance, that could be criplling financially.

OK Let's imagine he had killed a small child on a bike, would he be asking the parents for damage to his precious car? The guy is a fool. Tell him to stick it.

I find this all totally bizarre. If he had insurance, what would you all be saying? It is totally irrelevant whether or not he was insured, given that drjekyll ran into him (although I do agree it is unacceptable that he wasn't but that has nothing to do with the situation). If you had caused damage to another car you would have to pay for it, why not him? And I suspect from your wording of the question that the incident happened in a private car park or similar, in which case he does not need insurance. And I also suspect that he was stationary when you ran into him. It sounds like a bit of an unlikely coincidence if you claim you crashed into him on the open road. With friends like you, who needs enemies? BTW I do condemn him for driving without insurance and I hope this incident prompts him to sort it out!!
