A teenage pupil has accident whilst playing football in school and felt her knee go pop, her p.e. teacher helps a little and sends for a wheel chair, the head of the p.e department walks past so teacher asks for his help, he bends pupils leg causing massive pain, but tells pupil its fine walk it off, he then walks away, thee pupil was left to walk over 400 metres to see school first aider.with the help of her school friends, that person phoned pupils mother three times in 30 mins.as she was in so much pain, ,pupil taken to hospital by mother where MRI. Scan shows dislocation in knee cap, torn tendons, severere bruising to bones and a build up of fluid in knee, the pupil is a under 17 top athlete and is involved in many things in her area, she now has months of physiotherapy in front of her she will miss a season of competing, and even though her school has offered to help by given her home work she has exams in few weeks but it unable to get to certain lesson do you think the mother should complain to somebody higher than the head of the school

I agree with you there, her mother is a single mum who has struggled over the years, and money is tight ,but she has put herself through uni and gained a masters degree, taken her daughter all over the country to compete ,she also has a son who also competes hurdles again doing very well until he had to have year off due to hamstring injury ,she knows how the girls injuries are going to effect her ,competing is all her kids have wanted to do both have trained and worked so hard x
On the facts given - the P E teacher certainly has a duty of care towards the pupil and is in breach of it.

the main injury is the foot ball injury and so the question that has to be answered it whether the PE teachers actions caused further damage .

i dont know anyway if it were true if would be actionable
well you have put it in law so I am giing you a law opinion

and thirdly you ahve to think of what money damage or costs that you have incurred so far - very little

the other thing is that you cant sue on a chance
the pupil had 10% chance of being a professional footie with a total lifetime income of £5m so you would like £500k please .....

start with the complaint to the head master

legally I dont think there is alot of money in this claim ( and that is why you go to the civl courts ... )

I understand that peter its about why the girl was left on the floor, and not given first aid as required,, suing has not been mentioned by the girls mum, the knee could have gone at anytime like I have said. In other posts its about persons in charge not acting in a professional manner e.g there duty of care

To add all advice has said the knee should have been stablized and emergency service sent for ,this did not happen so there every proberbility more damage was done via the walking
PP I am certain the medical verdict will be that the head of PE made the injury worse by his action! It was against all medical / first aid advice.
No trained first aider would have done what he did! My son confirms that!
At the very minimum the head of PE should have told the girl to stay where she was while a first aider or ambulance was called. Bending the leg was very stupid and ignorant , he really should not be in the job if that is his attitude!
What are you hoping to achieve in the final outcome? Are you hoping that the Head of PE will be sacked or are you hoping for a big money handout?

Why does everything have to involve money, not all people are out for what they can get
Not about money I agree, but the school should at a minimum cover the medical costs, which as I said, may well involve private treatment at a specialist clinic.

I do agree with you there, also I think they need to look at maybe a private tutor so she can continue to study for her exams which are so important at her age
