Tony Benn was re-elected for Labour in 1959. The following year his father died and he succeeded to the viscountcy. At the time it was impossible to disclaim a peerage, and Benn was disqualified, the seat being awarded to his defeated Conservative opponent. He fought a successful battle to have the law changed and regained his seat. This proved timely, for a few months later the Earl of Home was chosen as PM. The new law enabled him to disclaim his peerage and seek a seat in the Commons. Home must be unique among PMs inasmuch as for three weeks until the by-election he was not a member of either house.
