Long story short
I was at toys r us a month ago my youngest daughter was 2 at the time newly potty trained and needed the toilet there was none available so we used the potty for from the boot of the car my mum put it in between her car and another ladies ( she wasn't in the car at the time ) the lady came back got in her car and started revving her engine to hurry up my mum gave her a dirty look pulled my daughters trousers up and the lady started yelling abuse at my mum while holding my daughter , telling her if she wants to give her a look like that she will punch her in the face I went other put my hand through the car and pointed at her telling her she won't be punching anyone especially while she's holding my child the woman grabbed my wrist and was about to go for me so I punched her in the face she then went for my mum ripping her earring out her ear soni grabbed her of my mum who was still holding my child and stared punching and scratching at this point an of duty police officer came over held me to the side until the police got there I was arrested ( the lady also shouted out at me she was going to get me done for assault
And rasim she was Asian so I told the police she's going to play the race card and aparently that rasict ) my mum Tommy 2 children back to hers I was in the cell from 3pm till 3 am realised on bail when I went back I got told I have to go court charged with abb this is my first offence of any sort I've never been in trouble before I'm just now worried I could possibily go jail as my solicitor said the uncle might make an example of me
I'm also worried about the effect it will have on my children if I do . The woman only had a scratch to her top lip and eye no bruises or anything either

Assault by beating is a variation of common assault.
The maximum sentence is 6 months in prison. But that sentence is VERY rarely given and in this case it is almost impossible. The only part I am not sure of is the 'racist' element. Racism can increase the seriousness of a charge.

I wasn't actually rasicst never said anything about her race until she said about getting me done for being rasict and I turnt around and said she's going to play the race card but there is nothing about me being rasicst in her statement and I'm not being charged for it

^ Then it's just common assault. Probably a conditional discharge or at most a short community service order ( working for free to help the community)

My mum had to go and make a separate statement for that and is waiting for police to be in touch they wouldn't take her statement there and then as it happend they told her to come back witch she did so now she's just waiting on that

I forgot to add I'm pleading guilty in court as I admitted to everything I done
The only thing that's making it look bad on me is that there's no cctv or witnesses ( apart from my mum but they won't class her as one ) for the beginning of the argument and the of duty police officer only see the end of my grabbing her my mum has photos on her phone of her going for me but the police also wasn't interested in those

Pleading guilty will give you an automatic 1/3rd reduction of the sentence. So if it was 15 hours community service it would be reduced to 10 hours or a £30 fine reduced to £20. What I said about it not being a possible prison sentence still applies. I still expect this to be a conditional discharge.Which means it is still recorded as a crime but there is no penalty as long as you stay out of trouble.
