It applies now, it's just that for reasons unknown we do not use it, which is ironic because it's one of the few EU laws that actually favours the UK. We implement all the loony stuff but inexplicably ignore the one law that would be useful.

I rather think that this means that we can legitimately deport all 'migrant' arrivals from France - doesn't it? Good.
Italy, etc. are going to need some help.
