New Bathroom Problem...

...In early April this year we had a new bathroom fitted. The room was turned round so the toilet was moved from an outside wall to an inside wall. All was fine until a couple of weeks ago when we noticed the carpet in our bedroom was wet up against the wall. The new toilet being directly on the other side of this wall. We reported this to the bathroom's project manager who said he would get the plumber to call me. The plumber came round, took the toilet out declared he couldn't find a leak so he reassembled it with masses of silicon and hoped all would be well. It wasn't, four days later we noticed the ceiling of the lounge directly underneath was becoming stained and beginning to bow. Again the bathroom PM was called and he said the plumber was on holiday until yesteday, the 29th.

Last Thursday the ceiling collapsed causing a 4ftx3ft hole. An emergency plumber was called and he imediately found the cause of the leak being a faulty inlet valve on the new toilet . This he replaced and the leak has stopped..dowstairs in the lounge the scene is very distressing. There is serious damage to furniture and carpeting. The ceiling is 'Artex' from 1970s and more than likely contains asbestos. Our own home insurance is well informed of events and an expert is coming round on Tuesday.

My dilema is do you think the plumber who installed the new toilet is negligent because he didn't find the faulty valve, because if he had of done and repaired it none of the ensuing mayhem would of happened.

Should I consider any action against him via his public liability insurance for the anguish, distress and vast inconvenience caused.

I am almost 70 years of age and I have never before been in any kind of legal situation and I really don't know what to do for the best.

Any and all help and advice will be greatfully received.

I really wouldn't go down the claims route as it will probably be drawn out and stressful. Is the emergency plumber willing to give you a written report which you could take to the original fitters?

CAB will also be able to advise on the best course of action.
Your contract is with the people who installed the new bathroom and you should look to them for compensation. It is up to them to chase the plumber who installed it of the manufacturer of the faulty valve.
Let the insurance company deal with it but do ask for a plumbers report.
