Strongly advise you do carry out the punishment no matter how guilty you feel and make sure punishment fits the bad behavior, if you dont you have a bigger problem later on and he will use crying to curve your emotions to avoid punhiment. after the punishment give him 10 mins to settle down then approach him and comfort and talk it through with him. he maybe 8 and sensitive but im sure he aint stupid comunication is the key to every child.
He knows fine well that he can do and behave as he wants and if you appear annoyed...hey presto here comes the tears and you'll stop being 'mean'
Like danger has already said, you must meter out the (appropriate) punishment when it's needed or he will get worse. It's managable now, but what about when he's 13 and bordering on being 6 foot?
I don't know what punishment you are thinking of. It sounds as though scolding is a punishment for your son.
Has he always been like this, or is it a change?
Maybe talk to him when he is in a good mood to see if there is a problem somewhere else (at school or with friends).
Praise him when he does things you want, but tell him when you don't like his behaviour.
When I put my daughter to bed we had a talk "what did you like best about today". This might be the time to stress that you love HIM even when youdon't always like what he does
