Selling A Motor Vehicle With A Fault

I understand that if you sell a vehicle with a vault that is dangerous or potentially dangerous ; then you have to disclose the information to the buyer .

However if you sell a vehicle with a fault that is not dangerous - are you duty bound to disclose that information - example in this case , a fault with the head gasket ?

Better to be upfront with the buyer but as long as you don't state that the car is in perfect working order that is okay.

Sell the car 'as seen' and tell the buyer you know nothing about the mechanics of cars and let him take it for a good test run.

I would advise you do at the outset. If the buyer says "any faults you are aware of" and you say "no", that's a misrepresentation and all sorts of actions may flow as a result.

Thanks for your replies - this was raised by a colleague who is selling his father's car .

Your point is taken Barmaid - but how far does this disclosure go -
Say for example your car is low on the mpg - would you need to disclose that info ?

Honesty and moral integrity are their own rewards. I would without doubt declare any faults or problems.
The rest is up to the buyer. No returns or refunds.

no it is not a crime to sell a car with a fault. Mine had loads but I never told the Broker anything as he was going to scrap the car anyway
