I am asking this on behalf of a friend. I know a bit about conveyancing but only from an admin view so here goes. In 1997 he bought a house with his girlfriend of 4 years as she was pregnant, they lived together a further 2 years before splitting, going to court and her being able to stay in the house until their son is 18 and paying my friend �15,000, he doesn't know what happens then but he is still named on the register and on the mortgage although his ex and her new partner make the payments. He seems to think that if he pays off the mortgage and goes back to court she will be made to move out. Any ideas?
Would the court have decided what happens when his son turns 18, I can't see that the ex would just move out. Would she be entilted to half the house? Would he have to 'pay her off' to have her name removed from the deeds?

Oh sorry just read again, they were never married ... well as far as I see it they still both own all of the house together and are both liable for the mortgage. It would need to be decided as to who gets what percentage of the house if it were to be sold, or one would have to buy the other out. If he paid off the mortgage she would still be on the title of the house wouldn't she so it wouldn't make any difference .... they either have to agree what to do or go back to Court.
