Domestic Violence - Common Assault
3 Answers
Hello,
In short - My partner came into my house to take my daughter which was sleeping in bed at the time as we just split up and I was a little upset and knew she would prevent me from seeing her so I said I would go away for a few days with her and she can return once she is in a suitable place for her to live - In that house she's been injured numerous times.
I have never had any convictions, I have just finished University with the highest grades in the year and currently in a good job.
I am charged with common assault and all I did was stop her from getting past me and waking my daughter however she's claimed I've pulled her hair, She has a witness which is a family member which I see is unfair?
The statement she has made clearly states that once she had our child I did not follow and I had no intentions of harming / hurting her but she's playing all the victim cards to make it sound worse than it is.
I work in a very successful industry and having a conviction will ruin my life, will magistrates take this into consideration?
Since this has happened she has made it difficult for me to see my daughter and purposely prolonging it to hurt me. In the Police statement she says I am an unfit father but then a few days later she said I can see her if I get a Child Agreement Order, does this go against her credibility as it's all lies as it is.
