There has already been a thread on this. There was a 50/50 'blame' figure according to the judge. It seems the cyclist was deemed partly to blame. Have you read all the case details?

In my link, yes. Three (pedestrian) witnesses said the cyclist was not to blame.

Yep, i saw that. They all said the woman was on her phone and wasn't aware of her surroundings. Witness pedestrians said she was in the wrong, and they said the cyclist did everything he could to avoid the crash.

Judge said "if she was on her phone she would be more responsible".

Witnesses said she was in fact on her phone.

Judge rules a 50 / 50 responsibility.

Stupid IMO.

Yeah ONE guy who probably fancied the woman who got ran down, trying to get in her good books. A busy body who had no idea of the actual situation. Evident by the contradiction of pedestrian witnesses who were looking at the road they wished to cross, instead of being cyclists focusing on riding a bike.

here a cyclist is NOT relieved of a duty of care to someone on the phone .... simples
