Boss Won't Pay Me

Hi I type reports for a doctor who provides medical reports for insurance companies. Usually as soon as I have typed the report, he will pay me. Now he's decided he won't be paying me until he gets paid which could be literally years when the case has settled. Is he within his rights to do this? Surely because I work for him I shouldn't need to wait until he is paid? We don't have a written contract as it's a job I do in addition to my NHS post and has always worked ok up until now. Can he withhold payment like this? Thanks.

Well folks I decided to bite the bullet, emailed him and said this wasn’t going to work for me, let’s call it a day and could he please settle in full. He’s replied to say how he fully understands and is sorry to lose me and will of course settle up - when he gets paid!!! AND .. he’s happy for me to continue to chase the payments for him!! Such a sweet and sickly response- I just want my payment now in full not piecemeal - what’s my next move?

I'd reply to him that as it was an oral agreement you are saddened that he felt he was no longer in a position to honour his word. I have a nasty feeling that you are going to end up out of pocket but do let as many people as possible know that you are saddened by this. I'm thinking that he won't be able to touch you legally for slander by going that route.

I think he's despicable.

Resend him your invoice with a 14 day settlement clause. If its not paid by day 15 send a reminder giving notice that you will begin court procedings . Then do so.

which you have to do thro MCO (on line small claims)
the rules change a lot -
your reason for claiming is - v short - I did typing work for him and he didnt pay what was agreed
then you have to follow their ruyles which is a witness statement which is more wordy

I suppose that you did his typing during your NHS time?
I also suppose that you did not declare your earnings from your "private" work?

I would pay my secretary monthly for her extra-NHS typing, but it is quite common for such secretarial work to be remunerated at the conclusion of a case.

Some solicitors are good at reimbursing Drs for reports, but some are appalling and i have had to take two firms of solicitors to court before getting my money.

Make sure that your finances are "squeeky clean" before taking legal action.
