Have I A Valid Claim ?
2 week ago I dropped my phone and it stopped working so I took it back to the shop I bought it from when I took out a 24 month contract in july 2012. I was sent away for repair but after 2 weeks it came back with a engineers note saying it was repairable but seeing as I had not took out any insurance I am stuck with a phone that don't work and 8 months left on the contract. Other than buy a new phone to fit my sim and get my moneys worth I was told to claim on my house contents insurance. As it was dropped on the stone floor of my property, have I a legal claim for compensation ?

Re your house insurance I think it depends whether you dropped it in the house/within your property or away from home. To claim away from home, you would need to have protection away from home for it to be covered to which you would have paid an additional premium. Not sure about the supplier if you dropped it then really it is down to accident not a fault.
Your insurance company will ask you if you have any other cover in force which covers your phone - if you don't,. and you have accidental damage cover for your personal possessions, then they may well accept your claim, but it depends entirely on what your policy covers. The fact you have a contract with a phone supplier shouldn't make any difference, if you didn't insure the phone with them.
