My friend is in a rented property, and as you stand at her back door and look out into her garden the house on the left is owned. That fence between them needs repairing so she checked and was told that you are always responsible for the fence on the right of your garden, so technically that is his fence. She also checked with the council who said the same. So she told the couple next door, as they had asked her to check. They disagree, and say she is wrong. And it’s down to each individual house.
They cannot agree on this.
Is there a set rule??
no set rule, but it's usually marked on the deeds which one is yours. Having said that my fence is on the right. However there is actually no legal requirement for any fence at all, let alone a reqquiremtn to fix one (unless it's dangerous)
If it's his (the neighbour's) fence she can't force him to repair it so she either needs to leave it broken, try to negotiate to share costs or pay for it herself if she want it repairing.
If it's hers she has the same choices.
Okay if it's the council's property she should ask them too if they'll foot some or all of the bill. If not either leave it unrepaired , try to negotiate with neighbour or pay for it herself
You have an obligation to prevent your pets wandering into next door's garden so, even if the fence belongs to her neighbour, your friend must repair the fence if she has, say a dog, which might wander. Before cat-owners complain, I think it's compulsory for cat owners to ensure that their pets relieve themselves in someone else's garden.
I don't seem to own either of my fences. The neighbours on my left own the fence to the left of my garden.
Many years ago the nasty neighbour on my right knocked down my front garden wall on my right and built a new wall. I spoke to her about it and she yelled at me that it was her wall.
The deeds to my house are pretty much useless as they don't specify anything about the fencing/walls.
Basically I don't own either fences/walls to the right or left of me.
My friends fence has clearly been damaged in the wind. Landlord insists it’s not his side so just wanted to see if their was a clear rule...... I’ve Googled this for her and it’s just not clear....
