Does A Change Of Use From A Dwelling To A B And B Business With 6 Cars Having To Reverse Out Near A Dangerous Bend Require A Safety Management Risk Assessment
planning appeal re pedestrian, guests and onroad traffic safety falls on deaf ears when my brother could have been killed this year as a pedestrian badly injured where reversing cars cannot manoeuvre frontways and cannot see before they head across pavement onto dangerous road with 2 on road parking vehicles to their right left reducing visibility and a dangerous bend to their right. They end up in the middle of the road. Surely a Risk Management Assessment should be implemented lawfully under health and safety, environmental health planning conditions. Can Planning be taken to task for approving this

This would (shopuld?) have fallen under a 'Highways' report as part of the planning process. You should be able to look on the local authority website's planning search facility (they all have them) under 'documents' for that application and se what they said. Health & Safety isn't, per se, anything to do with planning.

The trouble is that if appeals against approval were to be allowed, the whole system would probably grind to a halt. There is a presumption in favour of approval unless it can be established that there wold be significant harm to intersts of acknowledged inoportance. As long as the LPA took everything relevant into account and followed the book in complying with legislation and procedure, then their decision would stand.
