Access to son

My brother's ex has taken their three year old son out of the country for a holiday and would not tell him where they have gone.My brother is really upset by this but is too scared to take any action against her as she may try to stop him seeing his son.I would have reported her to the police personally,but he won't hear of it.It makes it especially hard for him as she has also taken her boyfriend with her who has treated the boy badly in the past.Any advice on what he could do about this situation ??

I presume that your brother was married to this woman. He has no right to stop her taking the child on holiday but should he suspect that the intent was to actually leave the UK for good he should immediately go to his local CAB or solicitor. If he suspects that the child is being abused he needs good evidence to take the matter to court. It is a horrible situation to be in.

Thanx for that JRB, at least I can tell him where he stands now.They were never married for the record.

whitbybabe - if they were not married he should apply for parental responsibility through the court which will at least give him some say in care of the child. Advise him to consult his local CAB soon. If he does not know where it is give me his residential area and I can let you know. I actually work for CAB but in the Channel Islands, not the UK and the laws are slightly different though sadly the problems are all too common.

I hope that he will contact them and find out exactly what rights he has and how to apply for parental responsibility if he wishes to do that. Good luck!
