My partner has had her previous contract terminated this week but will be rejoining the same employer (in education) from the start of the New Year. As there is a break in employment should a new DBS application be required? We believe it should as this would be normal process when in this employment type.

According to this site, a new check would be needed only if the break were more than three months.

The DBS checks are portable now & held on a central system and renewed every 12 months. Your partners DBS should still be in place. There employer can view it online or just ask to see a copy
