Speeding ticket ( fixed penalty)

Q1. If I ask for the details of the print out of my speeding offence i.e time and location etc, will that affect the fixed penalty?

Q2. Although my speed stated in the notice of 39 mph in 30 mph patch .will I be allowed to take speed awarness course locally to prevent 3 penalty points as I have just taken up a part time work wich involvs driving. S.N.Laha

Your penalty is fixed at the time of them sending you the letter so you can ask them, might even be able to get a copy of the photo although they might charge for that, not sure.

Speed awareness courses seem only to be run by certain forces and in certain areas. For example my dad got one a few months back in Cumbria and they didn't offer that. If it was possible they'd no doubt mention it in the blurb.

You need to ask for the photos as this is the evidence. Without these you cannot defend yourself.They rely on people not asking for them and just paying up.

They will not give you a copy of the photo, this is only produced if you want to go to court.

You need to remember that by accepting a fixed penalty you are admitting guilt and are willing to dispose of the matter without it going to court. Because of this the prosecuting authority needs to produce no evidence against you at all, but merely needs to inform you of the facts as they see them. This information usually includes the date and time of the offence, the location and the speed alleged. This is all usually provided with the Fixed Penalty Offer.

Having said that, �Safety Camera Partnerships� (for it is they, in most areas, who issue the Fixed Penalty Notices) will usually allow you to inspect the photographs taken which substantiate the offence. This is usually by appointment at their offices. Check with their website or phone their office for details. Such an inspection will not prejudice your right to accept the fixed penalty.

Only if you decline the offer of a fixed penalty do you have an absolute right to see the photographs. If you challenge the allegation in court by pleading not guilty or by pleading guilty but disputing the speed at which you were alleged to have been travelling, the photographs would almost certainly form part of the evidence against you. They must be served upon you before the trial, otherwise they cannot be used.

As has been said, not all areas operate the Safety Awareness scheme which invites drivers to take part in a course instead of receiving penalty points. If they do they usually tell the driver of this option at the time that the fixed penalty notice is sent out.

Oh, and by the way, maviscoull, 39mph in a 30 zone is equivalent (in percentage terms) of 91mph in a 70 zone. Surely you would not think being prosecuted for that a �bit much�.

In addition, speeding in built up areas is viewed upon by the courts as more serious than speeding on a motorway. At 30mph the stopping distance is 75feet, whilst at 39mph it is 115feet � over half as far again. If struck by a car at 30mph one in ten pedestrians is killed. If struck by a car at 40mph one in ten survives.

I contested a speeding ticket once and my fine rose form the firxed penalty to �185!
