Facing Redundancy whilw pregnant

Just heard that i will made reduntant ,and my worst worry now is that i am going on maternity, knowingly who wants to employ me. I have been working for this companyfor five years and cannot afford this. So if anyonewith good advice can help me it would be nice.

I think there are a few questions you need to answer first - like why you're being made redundant? how far pregnant are you and do your employers know?

I would certainly seek the advice of an Employment Solicitor though as it certainly doesn't appear in this day and age that companies can make you redundant without good reason, and proof of that reasoning - especially pregnant workers.

Contact a local Solicitor and ask them about a free first interview - they should be able to deal with everything at that meeting, and of course if there is a claim or a case to be made, they can discuss funding options with you at that meeting too.

you have to be given 90 days notice of intended redundancy and there should be various options, e.g dispersal to other branches of the company. the HR deparment should have a meeting with you.

I am sorry to hear of your siutuation.

90 days notice is required, however it depends on the number of employees at the place of work. I will try to explain.

The employer must consult with 'appropriate representatives' of employees if it is proposed to make redundant 20 or more employees at one establishment within a period of 90 days or less.

'Appropraite representatives' are:-
- Representatives of a recognised trade union or
- representatives elected by the employees.

Consultation must begin 'in good time' and at least 30 DAYS or for 100 or more redundancies , 90 DAYS before the first redundancy is due to take effect.

Intial written notification to appropiate representatives must provide infrmation on the reasons for the redundancies, the numbers and the descriptions of the employees affected, the selection procedures and the proposed method of calculating any non-statutory redundancy payments.

one to remeber -

Failure to consult gives rise to a complaint to the employment tribunal and possible protective awards of up to 90 days' pay per employee affected by the failure (wether made redundant or not).

In many cases the 90 days does not apply because less than 20 employees are involved.

If you think you are being made redundant because you are pregnant then it almost certainly amounts to unfair dismissal. possibly also with a claim for sex discrimination. Get advice from the CAB &/or an employment solicitor (but be careful about the cost if you do the latter - try for a free initial interview and then a no win no fee arrnagement if they take the case on).
