problems with landlord?

around 1 month ago we viewed a property, a brand new never been lived in before property. it had no floor coverings and no window coverings. when we walked in the manager of the estate agents showing us around said 'carpets or laminates and blinds will be fitted'. fair enough. we loved the property and we paid to have the credit checks done, these were done by the management company who manage the property.

of course all checks came back clear and we were told we could move in the week after, but decided to wait till the next month so we knew where we were with rent and bills etc etc. which was 2 weeks later. on monday 29th sept my partner signed the tenancy agreement. when we went to the property there were no flooring or window coverings. we phoned estate agent straight away and they were as shocked and confused as us. we then had a phone call from the management company, who had done the credit checks etc.they said the landlord had cancelled the carpets. nobody knew why or thought to tell us it had been cancelled.

we were sorting through a junk mail pile and a letter was addressed to 'the tennant'. the letter said not to pay original landlord any money as the propertyhad been put into hands of receivers,which were the people who sent us the letter. we told estate agents and they wanted us to come back into the office and then they got on the phone to the original management company, who had spoken to the new management company. we were told not to worry, the new management company would honour our original agreement and the estate agents gave us choice of what to do, get deposit or we could take it, we said we had booked a van and people had taken time off work etc to help us move and agents and original management company told us to go ahead then and move our stuff in, we would be looking at tue/wed for carpets to be done. which was fair enough, we were ok with the wait. we did what they said and moved stuff. but of course couldn't live there with concrete floors. so nearly a week later our stuff is there, new furniture still wrapped etc etc. clear to anybody who sees that we have never lived there.

tue came and nothing was done, the receivers who are the new management company kept stalling and wouldn't return our calls, same wednesday. on thursday after noon we were finally told negotiations between the original carpet fitter and new management (aka the receivers) were on going as carpet fitter wanted money up front and management didn't want to pay upfront.

i was given the number of the carpet fitter by the new management to check up on what was going on in reguards to him. literally 2 hours later when we went to estate agents to yet again complain they phoned the management company up and the management company said they wanted to see that flooring and widow coverings would be fitted 'in black and white' on the tenancy agreement. as estate agents said, it wouldn't be in black and white as its just what happens, what comes as standard, as granted. the original management company had been on to the new management company and nothing has been sorted, athough we signed for with flooring and window coverings. can somebody tell us if we have any rights? is there anybody we can complain to? of course the management company and the estate agents failed to start with by not ensuring property was as it should have been, same with not letting anybody know the landlord had cancelled carpets. apparently nobody can track downthe original landlord. could we get the past weeks rent knocked off/waivered? as of course we couldn't live there with no carpets and have been fobbed off with excuse after xcuse? nobody is accepting responsibilty. nobody has appologised. the estate agents told us they had never dealt with a problem like this before, and have said a property marketed as without carpet isn't going to get interest and no reputable estate agent would even attempt to rent it out.

we can get our deposit and 1st months rent back as estate agent hasn't sent it off with the contract, estate agent manager who showed us around said we technically don't have a contract with the new landlords aka the receivers aka the new management company, but would loose the �175 for the credit checks we had done, and it would cost us yet again to move with a van again, aswell as having to pay for storage and checks for another property... it'd be cheaper to lay carpet ourselves. if we were to put carpets in ourselves of course taking it when we went, so as to leave property as we found it, as our contract is only for 6months could they not renew our contract, just because they wanted us out? or would they have to have a reason to not renew the contract?

any advice about any of the above would be great. thank you!

just want to add - sorry for the big long post i had to put it on many seperate messages as i didn't realise how long post was! also wanted to add partner phoned citizens advice, but they were no help what so ever, the women wouldn't let partner get a word in edgeways and was talking for less than 2minutes of what he said sounded like a reeled off generalised script, before she decided she was done and said bye.

ok, i think your question is about if they can just not renew after 6 months? The answer is yes, if youve signed for six months, there is no imperative on the people letting it out after the six months is up to carry on, so they could ask you to leave. Tey can use any reason they like (with the possible exception of race, sexuality or gender). For example i once lived in a flat on a 6 month tenancy and the landlord had a heart attack and needed the flat to live in himself after the six months was up. it works both ways though - you could also leave after the 6 mnths

and of course if the situation we are in at the mo, if theres anything we can do about it? do we have rights re. flooing fitted.

if we have kept up to date with rent etc and property in cond. we got it, they could still ask us to leave then yeah? im sure the management company wont want to live in it themselves , plus it is around around 2hour drive away. could they put the rent up to a huge amount, or would is there a cut off amount? thanks for your help :)

yes they could still ask you to leave - the contract is for six months. At the end of that, both parties can decide whether to renew or not
