I live in a mid terrace housing association. I have a alley rear of garden with gate. Used for rubbish bins and general stuff. A lady who lives over the back with no access to it from her house as it has a 7 foot brick wall there.  says she owns the alley on her deeds and said I can't use it. Even said if my place was on fire I can't use it and will have to stand in garden with my 4 kids!

All our lands were owned by builders and our terrace block was built 5 years before hers. Def a mix up on the deeds.

What rights do I have ??

Ask the housing association.  Continue to use the alley, if your neighbours also have use of this alley, talk to them.

And what do your deeds  say?

You can her Registered Title and Title Plan from the Land Registry, you can download them for a fee of  around £3 each

How long have you lived in your property?

Thanks for your comments. I've lived here since late 2008. I used to live at the back so saw the houses being built etc. They are on her deeds. But that was a mistake be cause her property is not even part of it. I feel I still have right of access by law other wise my house surely would be unhabitol due to safety. I'm a moat housing tenant and even tho they can buy alley for £1. They don't reply to me. I thought it was the easy way out.

It's on her deeds but in downloaded off government site it show ours with the alley but her bungalow not on it yet. Just the builders small building.

Why do you say the HA can buy it for £1?

LR records are suspect - I'm about to open a dispute with them over mine.

Lots of properties have no rear access yet are legally habitable.  We still have back to back houses and many thousands  of houses have gardens which only have access from the house.
