Is this age discrimination?

There was a poster in the chip shop asking for volunteer drivers to deliver meals on wheels - must be 75 or under!
I can just see all the 76+ drivers protesting that this is discrimination!

Although the age discrimination legislation doesn't apply to people over 65 (or to voluntary posts), I can think of some people who might genuinely see this as age discrimination. I know a guy who's a lot closer to 90 than he is to 80 who still works full-time (and for long, unsocial hours with some heavy lifting involved) running a wine shop and off licence. His only assistant is his wife who is also old enough to argue that the notice is discriminatory.

age discrimination does cover people over 65 as an employer is not allowed to automatically retire people now if they want to carry on working so that message earlier is not true - if there is a business or health and safety reason then they could discriminate this is probably as someone said to comply with insurance but if it isnt then yes it is discrimination as you are not now allowed to ask for age or years of experience or date of birth when receiving applicants for jobs
