Hello my mother signed half of her house over to me around 10 years ago but since Covid has lived with me. My son and his partner currently reside in my Mum's house. My Mum has dementia and I'm wondering whether we will be forced to sell her home to fund a care home should this become necessary?
You need advice. no not us.
she signed over the house ( 1/2) but you dont say if money were involved. no dont say!
\It depends on whether the occupier paid rent and this was declared ( and taxx paid)
so there may or may not be a capital gains tax charge, whether there was "reservation of benefit" and what you do about it now
( get advice) - sort out now
The house was never sold so still belongs to us both. With her being elderly I moved her in with me during Covid and she never returned to her own home. My son is now living there with his partner whilst they save for their own home so my question is, can we be forced to sell the home and give up my Mum's share to fund a care home or what would happen if I moved my son into my own home and moved back into my Mum's home with her. I've read if it's a relative over the age of 60 which I am, they are not forced to sell?
