Incorrect.
The proposal is to take action in the European Court of Justice (ECJ).
The ECJ is the court the EU uses to settle disputes about its treaties. Its jurisdiction over concepts of EU law that arise over the interpretation and application of the Withdrawal Agreement (WA) lasts as long as aspects of the WA remain in operation. In the case of Part 2 of the WA on citizens’ rights, this is as long as EU citizens and UK nationals covered by Part 2 remain alive.
The European Court of Human Rights (ECHR) adjudicates on alleged transgressions of the European Convention on Human Rights. It has nothing to do with tthe ECJ (and vice versa).
This threatened action arises from alleged breaches of the WA and not from alleged contravention of Human Rights so whether or not the UK remained signatories to the ECHR is completely irrelevant.
In that case it will make no difference.
If the UK government has broken the terms of the ridiculous agreement they signed that should be addressed.
The current government may make a few agreements with the EU for reasons best known to them. But they will be revoked with the return of a proper government.
