"You said it was pitch black.  It was not.  There was a light on in his breakfast room (which he claimed blinded him)." - ok but either way he could not see.

A jury considered all the evidence, not only that which the media considered would interest their respective audiences.

The Jury had the option to consider a manslaughter verdict but found him guilty of murder by a 10-2 majority.

TORATORATORA, you posted, "It's easy for you et al to lay out the details and what should and should not have happened from your living room."

That also applies to you.

The jury obviously did not believe him given that one shot would have had to have been aimed through a 10 inch gap which had he been completely blinded would have been quite lucky.  I think the light in the breakfast room actually may have come from their torches (the transcript is not clear).  You can argue with me all you like but the fact is 

a) the jury found him guilty and did not believe his account 

b) he was in possession of two unlicensed guns (one a shot gun and one a pump action) and had previously said that he would lie in wait and kill any burglar

c) the Court of Appeal overturned his conviction on the basis of his mental condition and substituted a conviction for manslaughter - with a considerably lower sentence, but the case was not overturned on any factual basis

d) it does not make those who tell you facts "scum lovers" or "trobiscites".  These facts were tested over many days (if not weeks) at a trial, with many experts some of whom gave evidence on Martin's behalf.

e) by all means you are entitled to opine that the prosecution/conviction etc was wrong and he was perfectly entitled to have 2 unlicensed guns and shoot people in the back - however, my view is a less insulting approach might be more conducive to discussion.  

I'm not arguing I take your points as valid. I understand why he was convicted. I just don't know what else someone in that position is meant to do. As above the law is an ass if we are not allowed to defend ourselves in our own homes.

Was the force he used reasonable in the circumstances, given the fact both men were attempting to get out the house and away from him?

TTT - Of course we are allowed to defend ourselves in our own homes.

The law asks that we use reasonable force to do so.

The position of the judge and jury was that TM far exceeded what counted as reasonable.

 

In the USA he would have been a hero. Here he was a zero. I would lay down my life to protect my family, as I'm sure several others would do. The law can kiss my ass.
