When I seperated with Ex (father of children) we transfered the property to my name and I payed the mortage ever since but he is named as a lender alongside Halifax on the title deeds. I recall 10,000 being an agreed figure.

Can I move house?

You can only sell your house if it is free from all charges registered against the title. The mortgage is paid out of the sale proceeds and the Halifax would then release its charge. The same goes for your ex - give him the 10k and he releases the charge.

If he agrees the charge could be transfered to the new property but it would have to subject to the approval of your new mortgage lender and their charge would have to take priority
I worked for a finance co for 2 years the process was that the amount outstanding as a charge ( a loan secured on property) was paid off upon transfer of funds directley to the lender in this case the Halifax, you will need a redemption figure off them to know how much is outstanding though.
