divorce- pension sharing
2 Answers
I will be divorced in 2 weeks and still havent completed my financial settlement with my ex. We are amicable and I dont want him to take advantage of me. His pension is worth 180K. I have a low income 12k due to raising children , who are at school, but I gave up my main career to raise them.He is a high flyer and earns 80k. What kind of maintenance for two children should I expect? Can I have a pension share , even though my income is much lower than his?

If you only have two weeks to go it seems a little late to sort out something so complicated as pension sharing. You do not say what is happening to the family home or how long you have been married but it sounds like a fairly long marriage. I would say you should expect at least half the house if not more and half the pension, which is one of the most valuable assets of the marriage and the Court usually thinks that you have assisted him by maitaining the home etc. etc. that you have assisted him in building up said pension. You should now be awarded it in your own right so that it will be nothing to do with him anymore and you can then take it or do with it as you wish. If the children are at school you should also get maintenance. I am not expressing any particular view on it, just conveying what I think you would get.
Ask yourself honestly - would your husband have been able to acheive his present position, fiscally and practically, if you had not provided the family, home and emotional support for him to do his job to the best of his ability (without prejudice) for which he is now reaping the rewards.
What do you think is fair and equitable? I would certainly expect to include a pension in a division of assets. I would suggest that you seek professional advice in this matter asap.
