My boyfriend bought me a car and is registered in my name there are no financial payments to make.We have now split up and he is threatening to take the car back am I legally entitled to keep it?
The only 'gift' you are legally obliged to return after a relationship ends is an engagement ring ~ and this is only enforceable if the guy takes you to court.
I would assume the car was a gift, therefore you are entitled to keep it. However as Ethel has pointed out would you really want to keep it? in my opinion I would be likely to just hand it back as if it were a piece of paper..make out it means nothing to you!
The car is registered in your name..therefor the car is yours tell your ex to take a hike or take you to court .He will have to pay the court costs when he loses...which he will.
For an example, some company/lease cars are registered in the employees name, but the ownership belongs to the company or the lease company. The car does not belong to the employee. They are the registered keeper, not the owner. Just like someone is the tenant but not the owner of the property.
I was in the same situation a couple of years ago. The car is yours, you are the registered owner and it was a gift. And, hello?? of course you should want to keep it - we can't all afford to give away cars and buy new ones at the drop of a hat! I told my ex that I'd spent about half the value of the car on all his xmas and birthday presents (which I wasn't asking to be returned) and the car had decreased in value to the tune of the other half and so we were quits. He's showing his true colours to you now - you are better off without him and you have NOTHING to feel guilty about!
I'd sell the car then change my telephone number. Once you get a gift, that is that. It's yours, to keep or sell or even dismember. As you say, he bought you a car- didn't just let you use his- so it became yours.
