If I were to change my name to Tom Cruise and sign a photo and sell it on ebay would the winning bidder have any right to complain?

No - unless you have specifically led the buyer to believe that it is a different Tom Cruise. e.g. if you have not published a photograph of your photograph on ebay, then it's up to them. They could only complain if you published a photograph of a photograph other than the one that you were selling.
But what could happen bernardo is you could sign a picture of the real Tom Cruise. I think on e-bay there would be little you could do but in a shop that would be misleading advertising.
You would ultimately get negative feedback posted against you and eventually no one would buy anything from you
Are you short and Gay also?. Forget Tom Cruise - Tom Jones is more like it plus there must be millions of them in Wales.
