Unfair insurance

In supermarket car park a car ran into the rear of my vehicle whilst driver was speaking on a mobile phone but insists that i reversed into them and will take no blame. No police involved, no one hurt, No independent witnesses.
I dont want to claimoff my insurance as policy excess and loss of no claims would cost more than the repairs.
i have reported the accident to my insurers who maintain i have to make a claim as the other party are looking to claimoff my insurance. I have now made a claim as asked for with the result that my insurers now tell me i will lose my excess and my no claims which all seems unfair as the fault was not mine.

You should have refused to claim off your insurance b/c its not ur fault. The insurance company just cant be bothered with the legal stuff, it would cost them more so they want you to claim ur own insurance. You should try a no win no fee solicitor and see where u stand, normally they could tell straight away if u have a case or not. Sometimes they might even split the blame accordingly between the parties, 50/50 or 30/70 etc...it all depends.

Somebody rolled back into my car today at a traffic light and they hit and ran, i chased her and she didn't stop to check for damages, I took her number plate and luckily there was no damage to my car. I mean it doesn't matter if u caused any damage or not, if u hit someone u should stop, that stupid woman.
If they're not bothered about the legal bits then get out your car with your crook-lock and whack him round the head with it. No witnesses and you could claim that he reversed his head into it.

Had similar thing happen in Sainsbury's Darlington. I was sat in the car when a tool in his Grand Cherokee nudged my car when he was parking it. His missus got out and checked the front end and mentioned something about leaving a note and her hubby said no as they wouldn't be able to prove it was him.
The bit they neglected to notice was that I was in fact in the car at the time. It is a fairly old off roader itself so any damage would indeed be dificult to prove from one car to another. I would probably have not claimed as it was on the bull bar and not worth it.
However, I got my revenge onhis dishonesty by using my steel toed boot to put a HUGE dint in the driver's door and left them a note saying 'SHOULD HAVE LEFT A NOTE'
I was in the car with my mother, in a garage queuing up for the car wash, when a guy tried to jump the queue. He was pushing in front of the car behind us and nudged the back of my mothers car. He got out screaming and shouting calling my mother names and claiming that she had reversed into him. The guy behind got out and so did I ~ my mum was shaking with fear coz this bloke was abusing her, so I called the police. Guess what? They weren't interested, never turned up. This moron drove off without leaving any details. Even though we had a witness (guy behind us) and we had his registartion number, the police said it had happened on private property (garage forecourt) and it was an insurance matter. They just weren't interested that he drove off.
We contacted our insurers who took up the case. They were really great, helpful and trying to sort this out. When they finally found the owner it turned out it was a woman owner, who denied it had happened and said that she was somewhere else in the car that day. Tried to get some cctv footage but only the pumps were being monitored, tried to get the police involved but they said as no one was injured and we couldn't prove it was this womans car (she was saying it was only insured for her to drive and no-one else had access ~ hmmmm!) they couldn't do anything. We ended up claiming from our insurers. Luckily we had protected no claims, but it still put the premium up the following year. I hope the jerk gets spanked some other way, very financially painfully. Moron that he is.
Whilst this is very very very frustrating - and I do sympathise - what do you expect your insurance company to do? He is saying your reversed into him and you are saying he went into the back of you. There are no independent witnesses.

Ignore what jean has said - getting legal will be a complete waste of time and money.

As I say, it is very very frustrating, but you may well just have to take this one on the chin - unfortunately some people just don't have the honesty to hold their hands up and admit fault.

Actually, it doesn't cost anything if you enquire with a no win no fee solicitor, normally they could tell u straight away if u have a case or not. They will not take on a losing case. I have used them in the past, very helpful.
I know it's kinda of hard to prove here but if it's a matter of principle than u should enquire, and sometimes u can tell a lot just from the damages.

So that woman's car has no damage to her car at all?? And you have a witness seeing the car? No case? Again the insurance company can't be bothered with the legal stuff.
My was similar, I had to go to a no win no fee solicitor b/c my insurance company didn't want to waste time and money. For them it was cheaper just to repair my car claiming on my insurance.






Points of principle costs money I'm afraid.

Put yourself in the place of the insurance company: if it costs, say, �1,000 to repair a car and leave it at that or �1,000 to repair the car and then �25,000 in legal costs to pursue the other party, without any guarantee of success - espeially in a case such as this one where it is one word against another with no independent witnesses - what would you do?

I know damn well what I'd do.

Accidents are emotive issues, as you have proven by going to an ambulance chaser in the past, but sometimes it is better to take a step back and look at it as objectively and pragmatically as possible. I know it is frustrating, I've been there.

Also, if insurance companies pursued every single lost cause you and I and everybody else who buys insurance in this country wouldn't be paying hundreds for our insurance, we'd be paying thousands.

It is the common pool principle.

What would you prefer?
That's what I am trying to say insurance company are not pursuing cases for their customers. I have been there many times. You really think ppl will owe up to their faults, of course not and how often there are witnesses.
It's up to you what you want to do the options are there, you either have a case or not have a case, simple as that, cost one phone call.
