Neighbours conifer tree roots breaking up my drive. Are they responsible?

My neighbours conifer tree roots are breaking up my drive. My insurance company says I cannot claim under my insurance. Do I have a claim against my neighbour and/or their insurance. What is the correct proceedure to follow. Thankyou.

There are new laws concerning leylandii owners which can result a in a �1000 fine for non compliance. I don't know the name of the website now but we got all the details off the BBC NEWS/POLITICS site last year. I'm sure you will find it with a bit of a search.

Why not dig out the roots and re-lay - might even kill the tree if it's an eyesore. You could ask your neighbour for help with the cost. If he/she's unhelpful, you are perfectly at liberty to lop off any or all overhanging branches and then lob them back over the fence onto his ground.
