Of course there is bias in the Criminal Justice System.
Nearly all the senior posts in the CJS are held by
educated, middle-class men, with educated, middle
class attitudes to women. This means that two distinct
models are in operation:
The Chivalry model, and
The Evil Woman model
The former sees women as the fairer sex; up there
on a pedestal they can do little wrong, but can easily
be led astray by evil men. Since they commit far
fewer cimes than men, and less serious ones too,
they deserve greater leniency.
The latter, the 'Evil Woman', is one who maliciously
ignores the feminine conventions, proving herself
to be unwomanly, and deserves to be treated as a
man. Myra Hindley was a good example. She served
the equivalent of 3 or 4 life sentences because she behaved in a way far-removed from the typical
stereotype of 'the gentler sex'.
