legally. can my girlfriends ex husband withhold their daughters passport to prevent her child from going on holiday with us?

I believe that if he applied for the passport , paid for it and is the primary carer the he could indeed withold it.
I suspect it may depend on what type of custody your girlfriend has. But if it's so important that she joins you for holiday, why not go somwhere in this country?
If he actually has the passport then I suspect he is the primary carer.

he is not the primary carer my girlfriend has custody. he has the passport because he took her abroad last year. we normally go holidays in uk. this would be our first time abroad with my girlfriends child.
Get your Girlfriend to re apply for the passport stating that the old one has been lost. They will cancel the old one, your girlfriend will get the new one the ex will have the smug grin wiped off his face. Might cost a couple of quid though.
if the ex husband is on the childs birth certificate i think he has to sign the passport application too, if the child is under a certain age, check it out online or on the info pack u get with a new application. If he won't give u the passport, you win't be letting him take his child abroard again, he is cutting off his nose to spite his face, wally..
If you require a duplicate passport and he witholds his consent, you may need to go to court to enable the court to give their legal consent to the grant of the passport.(if he stills refuses to sign)

If your girlfriend paid for it, you might look at a private prosecution for theft, at least get a solicitors letter asking for it's return.

Harveypool has the right answer. This is what I did when I fled my first marriage and he kept my passport. Good luck
My ex is on my kids birth cert but when I applied for passports for them nothing was mentioned about his permission. I'd suggest you go see a solicitor and get them to write to him requesting the passport as he has no right to withold it from you. If he won't, the solicitor will know what to do.
It is still cheaper and easier to declare it lost, and apply for a new one.
