Points on licence

If you get banned driving due to points, when you get your licence back does it still have the points or do you start again?? Many thanks...

i think they stay on for a 3 years. say if you got 12 (over 4 offences 3 each time) and got banned and the first 3 points had been on there 2 years. then u got your licence back after a year so the first points had been on there a total of 3 years now. they would go, you would get your licence back and have 9 still until the second offence had been 3 years. hope this helps

If you are banned purely as a result of totting up then you will have 0 points when you get the licence back but the offences will remain. If you get banned for and individual event then you will get no points for the new event but the existing ones will remain. For example I had 3 points on my licence and I got banned for 56 days for speeding and the magistrate said that he was awarding me a "nominal" 6 points. It was only when I got back my licence that I understood what he meant by that. I still had 3 points and the new speeding conviction was down there but with 0 points by it.

the previous convictions stay on your licence for three years. If you get another conviction within those three years they will be taken into consideration. If you get another conviction after the three years, those previous convictions are considered as being spent. However there are always exceptions to the rules. One of these is drink driving where the conviction lasts for FIVE years.

I'm sorry, but I disagree and Loosehead is correct. If you get banned for totting, when you get your licence back it is without points and you start again from zero.

PS Loosehead - I think in your case the mag was wrong. he should have declared that your licence would be endorsed but not given you a "nominal" 6 points. You were banned and thus you should not also have been given points -nominal or otherwise.

Yes barmaid but he said "Nominal" to indicate that it was a 6 point offence but as I was banned they wouldn't count anyway, I think he was trying to indicate the severity. As I said above there where 0 points for th offence when I got back my licence.

Bullpen, if you are going to quote things, get them right. Most offences stay for 4 years and the effect is 3. In the case of DD its 11 years and the effect is 10.
