Tree Roots

Hi, Has anybody had any experience dealing with tree roots that are spreading onto your property, and more importantly near your house.
The housing association own land next to my house on which there is a large lime tree. The roots are spreading and lifting the footpath running alongside the house.
I have written several letters and have had no response and am getting worried.
Have I a legal right in this matter? I am thinking of contacting my insurance company and seeing what they have to say as I would have thought they would have interest as they would have to pay out if any damage occured.

I think it's a good idea to contact your insurance company. Perhaps they could arrange for somebody to come down and inspect the problem. It might also be a good idea to contact your nearest Citizens Advice Bureau. I'm sure if the housing company received a letter from a solicitor on your behalf they would feel they had to respond to it but the CAB might have some advice for you on how to proceed without incurring any costs. Do be sure though that you keep copies of all letters you send to the housing association, and send them Recorded Delivery.

Also reckon there must be someone on AB who has had similar problems. It seems that trees seem to be a law amongst themselves Al
