Can i change my son's surname???

my son has the surname of his father. I was just wondering if I could change it to mine and how do i go about it?

I changed my daughter's surname from her father's to mine and it was incredibly easy. No I didn't get his permission to do it. I got hers. I paid a solicitor a small fee, but I don't actually think you have to do that as long as the document is witnessed I'm pretty sure it is legally binding. Be worth asking a solicitor though. I don't think it will be a big deal.
My ex wife had to get my permission to change my children's surname, my solicitor said she could not change their names by deed poll without my permission!! (I did allow it by the way)
You could change their names without the deed poll but you would need to still use their old names on official documents IE: passports driving licences etc. when they are old enough. as it would not be a legally binding change.

If the father has parental responsibility you need his consent. If you have parental responsibility BUT the father has regular contact with the child he can fight you in court over this. If you changed the name without needing his consent he can still infact take you to court to have this reversed. All depends on circumstances ...........
You would need to get his fathers permission Im afraid!

I was told that this was not a problem...but if he had been in his dads surname I would have needed his permission.
Once your child is 18 he can do this himself.
