our nabour has put their fences on to our land i know i can take them down but can i burn them or do we have to return them.

For more on marking an answer as the "Best Answer", please visit our FAQ.You and your "neighbour" need to civilly discuss the matter and you need to politely point out to them that the fence is on your land and request them to remove it and re-erect it on their land. Explain to them why it is on your land If they refuse - AND YOU ARE ABSOLUTLEY POSITIVE IT IS ON YOUR LAND - send them a letter by recorded delivery formally asking them to remove within 30 days. If they dont then do it - you can remove the panels and posts and leave them on their property. If you have to pay for that - send them the bill.
If you burn them - that can be deemed as theft.
Do it all amicably and politely and we wont be hearing about the consequences in our newspapers.

I would suggest you show legal entitlement of the land to your neighbour along with a letter of intention to them outlining your proposed course of action, i.e. removal of the fence.
Do NOT make any threats to damage or burn down!!! If you get it wrong you could end up with a criminal damage charge and a civil claim to recover the cost of the fence.
Like someone else suggested, behave like adults and be civil its cheaper.
