US Application Form

Hi, I am applying for a Job in the US, via an internal company transfer. During my time with my UK employer I was accused by a client of theft, I was arrested and I pleaded not guilty and the case was heard in Crown Court. I was suspended from work on full pay until the investigation had concluded and after 6 months I was found Not Guilty by a jury and returned to work. I have completed a number of interviews with the US firm and the next step is form application and I am unsure how to answer the following questions:

- Have you ever had or are there now any judgments or suits pending against you? Current answer NO

- Have you ever been a plaintiff or defendant in any civil matter in a court of law, administrative proceeding, arbitration proceeding or other tribunal? (E>G> contract matters, collection matters, divorce, debt matters, etc.? Current answer NO

- Have you ever been the subject of any governmental or regulatory inquiry, investigation or action of a civil nature?

This should include, but not be limited to, any inquiries, investigations or actions by the internal revenue service, director of practise, securities and exchange commission, Bar Associations, board of accountancy and ACICPA? Current answer NO
I have currently answered NO to the above question as this was not a judgment against me and was not a Law suit etc however I am not 100% sure I have answered them correctly.
I have asked for a copy of police records and the case is mentioned in the report as not guilty.
Am I write in answering these as NO or should I correct the answer?
Please help if you can. I just can not seem to get away from this court case.

You are right to answer No to all questions.

Not only is it accurate to do so but being found Not Guilty at law removes any slur on your good name. That is why we have a criminal justice system.

Thanks for your advice however would this be the case in the US as I am applying for a job in the US?

You WILL have to answer YES when it comes to getting a visa. As you will need one anyway (to work) it will be no big deal.

I disagree with the previous comment. No civil proceedings have ebeen taken against you. You can answer No with a clear conscience.

I recieved my Subject access report from the police today and it shows that I was arrested and found not guilty of the theft.

Question, Should this be on the record or should it be removed as I was found not guilty?
