we have erected a 6ft fence on our land. we left the boundary fence in place. the guy next door has removed the fence and dumped it on our drive and said it is our responsibility, in the title deeds it says we are both responsilbe for the boundary fence. is it up to us or him to get rid of the fence now he has cut it down.

Common sense says it is his responsibility as he has taken it down. Why did he remove it?

because he said it attracts rats having 2 fences, yet we told him all along we were going to put a fence up
Sounds like it's attracted one already.
Wait until the wind is blowing in his direction then make a big bonfire of it. Have a few damp leaves at hand to help with the smoke.

If it was you're fence and you're responsability as the neighbour is implying, then they have vandalised you're property and you are within you're rights to make a complaint to the police and local council. They had no right in destroying you're property, I would make them clear of this saying you are willing to overlook the incident as long as they remove the fence/debris they illegaly demolished. If you get no joy report them !!!
