Do i have to pay for her upkeep

my daughter has left home and gone to live with her aunt, and now the aunt is demanding money from me for her upkeep should i give her the family allowance which my child is entitled to. she will be 16 at the end June and Aunt is saying she will claim Child Support from me can she do this.

How long has your daughter been with her aunt, and is she still in school and/or planning to go into further education?

If so the answer may well be yes. If she leaves school you may have to pay child support until the September after her birthday (as child benefit is also paid until then). Maintenance is usually paid until the 19th birthday if the child goes into further education (up to A level).

However I think your best bet would be to contact the CSA and ask them what their rules are.

Thankyou for your advise pippa68 she as been in a lot of trouble over the past 18months and as become very violent towards me and demanding money all the time she says she is not on drugs, she was ex-spelled from her last school and the school she is attending now the teachers in her present school have told her that they will help her get a flat and she will receive benefits in the meantime my sister is like awarding her for her misbehaviour and told her last week that when she is 16 she can go and live with her on friday after staying out since wednesday my daughters excuse isshe could not get in touch with me because she have taken my mobile phone television and DVD and on friday said she was leaving so i helped her with her clothes i did not throw her out even though i felt like it and she's then walking and shouting and swearing down the street making her way to my sisters house (i do not talk to my sister ) she is then phoning my other daughter and son and when they try and talk to her she gets abusive towards them the message i received from social services says i have to pay for her upkeep while she is at my sisters then the question of child support as been mentioned i will have to talk to some one about this and where i stand with the law i got in touch with the police last thursday and they reminded me that she is only on bail for assulting a woman two months ago as for staying on at school who knows?

Your sister will soon get fed up with your daughter.A similar thing happened to a friend .Her stroppy 15year old went off to her aunts but after a while continued to behave badly the aunt couldn't cope and kicked her out.
As for child allowance I would just stop claiming it and let your sister go to the trouble of form filling.

Naff advise if the aunt(like her or not) is at least caring and watching your child why make her life difficult?
I have a daughter and will always be her mum love and care even if she murders. I would obviously not agree but she will always be your daughter and you should always be her mum.
Behaving in a decent non malicy way may set an example. I know it is hard but the child is still yours to love no matter what.
Oh God, sounds like time to change the locks on your house isnt it ?

i agree with suetheramble why make things difficult for her aunt even though you both do not talk to each other , i think you will find she is entitled to expect you to help with her upkeep until your daughter has left further education , if it was me i would sign over the child benefit to your sister , although reading on your daughters behavioural problems i think it unlikely your sister will put up with her for long!! Although it may go the other way and she turns into an angel for your sister , all depends on the boundaries she sets for her and whether your daughter accepts them from her as opposed to you!
