Unsigned Deed of Covenant lodged at land registry. Transfer of property took place 2002. Are we obliged to sign this now and are the covenants enforceable?

If the sale of the property was conditional upon the covenant being created, it could be argued that (because no such covenant has been created) the sale was never completed and you don't own the property!

I recommend signing the covenant a.s.a.p (and abiding by it).

In my view it is not possible to give a proper reply to this without more detailed information. What was the covenant about, when was it prepared, what effect does it have on the property, has the covenant been accepted as valid by the Land Registry & included on the land certificate?
