we part exchanged our car for 500pounds we paid 4000 for the new car we left our old car there and drove away the new one after paying for it in full. next day thay phoned up saying our old car was not worth the 500 and they want their car back. all paperwork has been signed they had two occasions to check our old car but did not seem interested. should we give them back the car in return for our old one or are we within the law to keep it
I do hope you completed the notification of sale for the old car & sent it off to DVLA. If not, make sure you do it now. Otherwise, you could end up with all sorts of parking fines &/or police enquiries if the car is mis-used & the new owner does not notify DVLA of the purchase.
Hi, I am a sales manager for a car dealer. If the dealer has not appraised the car then that's their fault. The only time that they could ask you to unwind the deal is if:
(1) it's been a taxi and you've signed to say its not
(2) it's been written off and you've sign to say it is not
(3) if they discover that the mileage is incorrect
Other than that, you're safe. All you need to do is quote the "Sales of Goods Act" and they'll run a mile!!
My husband spoke to the car dealer and told him the new car is now ours and if he wants to pursue the matter he will have to go through solicitors. Even he admited it is legally ours. None of the points that simep pointed out apply and yes i have sent off notification to dvla so hopefully we won't hear from him again.
