18 yr old son caught speeding - delays & what is a caution?

Sorry first time in posting so bare with me.....
My son was caught doing 60 in 30 zone mobile speed gun. Mate was chasing him but they never stopped nor questioned him even tho they saw him and knew what was going on & his mate even pulled up behind the patrol car and waited uh!. Anyway this was on 29th March he was not given any "producer" and the PC said that he would be logging it in the next week (weird) I looked up info on Internet and it said you should hear from them within 14 days of incident as we never heard anything sort of thought he had a very severe warning. Then Tuesday morning he had a summons to appear in court in post for17th in the statement given by the PC he said he cautioned my son but on the night we asked him and his girlfriend what happened and no caution was mentioned by caution I assume it is "you have the right etc."
I know we are a little simple but really don't commit any crimes so our understanding of law is "Bill" type. Best part is my son is SOOOOOO very careful but was being chased at the time and was shaking and extremely upset when the PC spoke to him. Can anyone help please???????????

The 14 days applies to a Notice of Intended Prosecution where no oral notice was given at the time, so does not apply in this case
The requirement is that the court papers are issued within 6 months of the offence.

As for the caution - it is not mandatory under PACE for offences such as speeding, so whether he was cautioned or not is irrelevant.

You say your son was being chased and was upset - it was his mate that was 'chasing' him - it sounds as if they were racing. I can't see any real mitigating factors for a defence.

Driving at 60 in a 30 mph area is grossly irresponsible and he is lucky not to be charged with dangerous driving. Can you imagine what the charge might have been if he had killed someone? Instead of trying to avoid the issue on technicalities he should plead guilty and take the consequences: no doubt the disqulaification he deserves.

What exactly is he being charged with? You haven't said.

It is disgusting that he is allowed on the road if he behaves like that, what would have happened if his GF had been killed? Her parents would never have forgiven him, he should learn from this, probably he will lose his license and have to resit a test.

He is being charged with speeding exceeding 30mph in restricted zone. He has already pleaded guilty as he is I was just trying to understand what he might face. He is not an irresponsible person just caught in a moment of madness which has taught him a severe lesson. He has wanted to drive from an early age and loves it the road was a wide road marked with two lanes mainly throughout with partial homes. Best part is that the other car was full of kids who had been drinking cans of larger and of course under aged even the new driver 17 years old (who incidentally is my sons GF best friend doing the chasing) had been drinking and had his 11yr old brother in his car.
He/we will of course face up to the charges and take what punishment is dealt I just wondered what he could expect and whether or not he should attend the hearing as he was told on the telephone that to submit forms with guilty plea and ring up the day after to find out result.
We all agree more so my son of the dangers and irresponsibility and believe me he now keeps just under speed limit for his own peace of mind and gets ridiculed for it from his mates.

Usual guideline sentence would be either 6 points or a 56 day discretionary disqualification, plus a fine, so your son is in real danger of losing his license.

Losing his licence would not be a total disaster at least he would be able to keep his full licence and not have to resit his test . If he just gets the 6 points his licence will be revoked by dvla and he will have to resit his test . But perhaps the police should have charged them with dangerous driving for racing totally stupid .

if i was being chased and was so afraid and upset enough to go double the speed limit, i would have stopped when i saw the police and told them.

if he's ridiculed by his mates for observing the speed limit, with this hanging over him, he might want to consider getting new mates. It does sound, whatever he says, as if some racing was involved. In my day (yonks ago) it always impressed magistrates if defendants turned up in person when pleading guilty to offences like this; to have his parents along probably wouldn't hurt either. But other people with more recent experience of the courts may be able to correct me if I'm wrong. 60 in a residential zone is far too fast; but I think everyone should be granted one moment of madness if nobody was hurt.
