Summary trials are held in Magistrates court and jury trials are in crown court.
if your offence is either way or inditable it will be in crown for inditable but can be either mags or crown for either way.
It could be if the trial is held in mags you are then transferred to crown for sentence if the mags feel thier powers are no enough to punish you.
What is the offence/ circumstances?
Regards

iam being charged with assault for striking a man to the head with a piece of wood, what happend was me and g/f where going to a friends house when both of us where attacked by a group of youthsi got attacked from behind and knocked to the ground and kicked about a fair bit, so when i got to my feet a picked up a piece of wood, not to hit anyone just to try to get them away, then i heard my g/f scream then made my way up thestreet to find her and when i seen her, her face was amess then a man came out of nowhere screaming and shouting at me, so i hit him because i thoght u was about to be attacked, my lawyer has said to plead not guilty on self defense, i alos suffered from concussion and i alos suffer from a kind of aniexty disorder, so im a little worried im might be sent to prison, i have n previous convcitons and have just been accepted onto a college course, so if i went to prison that would really screw my college course. what do you think will happend, also i live in scotland and i will appear for trial at the sherrif court.
