Spolier: The movie 'Gothica'

I have just seen Gothica (the movie with Halley Berry in it) and there is one point i dont understand...

To my understanding the character Penelope Cruz plays is being raped/beaten by the Sherif, so it turns out...why her? how does he get away with it for so long? Its hard to phrase the question but basically i want to know P.Cruz's link to the sheriff. Or it could just be a poorly written/loose plot. Id be grateful if someone can clear this up for me!

I liked the film but there were a couple of things I "didn't get" Who did kill Halle Berry's husband and if she did do it why was she set free? I think the sheriff got away wih it for so long because P. Cruz played a mentally ill patient who was not taken seriously, and as Halle Berry's husband was his partner in crime with their little den where they tortured,raped and killed women.

she was possesed by the girl when she killed him. Its an ok movie i thought, a bit loosely written though thanks for your input Harriet
