I have a 1979 motorbike with an exhaust that has ... not for road use... stamped on it, it has gone through two MOTs with it on and passed both with no problems,am I breaking the law? Any advice would be great. Thankis
Yes you are, I am a biker so I am not criticisig you, the police love to give out tickets for that if they check your bike, they set up stops on biking routes and bike meets.
As Toureman says, yes you are. Many bikers tend to get a piece of metal and weld it over the writing though, so you can't really tell it's not road legal and less likely to get caught. It's obviously still illegal though.
Have contacted the local police who have said... If its got not for road use on it .... it should not be on the road, and it could affect insurance!! well I never !!
I am intrigued why the MOT Testing Station(s) where the motorcycle passed on two previous occasions ignored the VOSA testing manual (amended around 2004 I think) that states the exhaust system MUST not have any markings indicating that it is not approved for standard road use, such as, ''not for road use'' or ''race use only''.
Loud or unmarked exhausts not stating "not for road use" or "race use only" are passable at the discretion of the MOT tester. If he likes you or is a biker he will often allow you to pass! If they do have the markings stated, the MOT tester can at his discretion give you an advisory sheet stating that you brought and replaced the silencer on site. What you do after you leave his forecourt is unkown to him sort of thing. I know two places that are very leniant in this way!! Good on them too ha ha.
