smokers v non smokers

do non smokers have the same right to be away from the workplace as smokers or should i just ban smoking till lunchtime.We dont have tea breaks as such you can eat and drink anytime whilst working

smokers have no rights to a smoke break at all, unless included in their terms & conditions.
We don't have official tea or lunch breaks either, if we take these we work longer. But we do sit & eat or drink when we want with the patients, so a break isn't desperately needed. But we would be able to demand one off site if we wanted (unpaid) Now the smoking ban is in, smokers pop out possible every hour for 5 mins, some make phone calls or do paperwork or have mini meetings (multitasking). Most people don't mind, because the smokers never go when they're really needed. But the policy is that if you choose (after managers offers of smoking cessation) to smoke during worktimes, then they must find a safe place for you and it is unpaid (equivalent to our tea or lunch break split up over the day)

Thanks probably best to employ non smokers from now on.Oh my god is that discrimination who would be an employer
