There is a convention that the owner of a fence has the posts on his side of it. (Think about fences at the front of a property, facing onto the public footpath. Have you ever seen one with the posts on the 'outside'?). However, as stated, it's simply a convention (and not law). The owner of a fence is perfectly entitled to erect it whichever way he chooses.
